Terms & Conditions
1. Definitions
- Services: Any and all services provided by the Service Provider, including but not limited to mixing, editing, producing, and mastering.
- Client: The individual or entity receiving the Services from the Service Provider.
- Service Provider: The individual or entity providing the Services to the Client.
- Fees: The monetary compensation agreed upon for the Services rendered.
2. Payment Terms
- The Client agrees to pay the Service Provider the Fees as outlined in the agreement.
- A deposit of 50% of the total Fees is required upfront to secure the Service Provider’s time and commitment. This deposit is non-refundable if work has commenced and is not applied to any additional services added later.
- The remaining balance is due within 30 days of receipt of the invoice for Services rendered.
- Late payments are subject to an additional fee of 1.5% per month on the outstanding balance.
- All Fees are exclusive of taxes, levies, or duties imposed by taxing authorities. If any taxes apply, they will be added to the invoice at the applicable rate and are the responsibility of the Client.
- Discounts may be applied at the discretion of the Service Provider.
3. Revisions and Additional Services
- Revisions to the Services are subject to an additional fee of $10 per revision after 8 revisions as outlined in the price guide.
- Additional Services such as adding production elements or mastering are subject to the Fees outlined in the price guide.
4. Cancellation and Refunds
- The Client may cancel the Services at any time, provided that written notice is given to the Service Provider.
- In the event of cancellation, the Client shall be responsible for payment of all Services rendered up to the date of cancellation.
- Refunds are not provided for Services that have already been rendered or for upfront deposits.
5. Dispute Resolution
- Any disputes arising from or related to the Services, or these payment terms shall be resolved through good faith negotiations between the parties.
- If the parties are unable to resolve the dispute through negotiations, the dispute shall be submitted to mediation or binding arbitration as agreed upon by the parties.
6. Governing Law
- These payment terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service Provider operates.
7. Entire Agreement
- These payment terms constitute the entire agreement between the parties with respect to the subject matter herein and supersede all prior agreements, understandings, and representations.
8. Rights & Credits
- The Client retains all rights to their music. Red Line Audio Productions may use excerpts of the work completed for its portfolio, website, and social media promotion following public release, unless otherwise requested in writing.
- The Client agrees to credit Ben Monti (Red Line Audio Productions) as the Mixing Engineer and/or Mastering Engineer, as applicable, on all digital and printed releases where credits are supported.
- When promoting the released work on social media platforms where tagging is supported, the Client agrees to make a good-faith effort to tag Ben Monti and/or Red Line Audio Productions (@redline_audioproductions) and include appropriate mixing and/or mastering credit, as applicable.
- Failure to provide credit does not affect ownership of the work but constitutes a breach of this agreement.
